1. Agreement
These Terms of Use govern your use of the Presias iOS application, Web archive, and related services. By creating an account, signing in, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Presias is a private personal archive for recording text, photos, videos, voice, dates, moods, and optional places. The Service may change over time, and some features may depend on device permissions, network availability, Apple services, Supabase, Google, RevenueCat, or other providers. We do not promise that every feature will be available at all times.
3. Accounts and authentication
You are responsible for the accuracy of the information used to create your account and for protecting access to your authentication methods. You must promptly contact support if you believe your account has been accessed without permission. You may use Apple, Google, or email authentication where available. Authentication providers may apply their own terms and privacy policies.
4. Your content
You retain your rights in the text, photos, videos, voice recordings, and other material you submit. You give Presias the limited permission needed to host, process, transmit, display, back up, and return that content solely to provide the Service, support your account, and maintain the system. We do not claim ownership of your memories.
You are responsible for your content and must have the rights and permissions needed to upload it. Do not upload content that is unlawful, fraudulent, invasive of another person’s privacy, infringing, abusive, threatening, or harmful.
5. Acceptable use
You may not misuse the Service, attempt to bypass access controls, probe or disrupt infrastructure, upload malware, impersonate another person, use another person’s account without authorization, or use the Service to violate applicable law. We may limit, suspend, or terminate access when reasonably necessary to protect users, the Service, or our legal rights.
6. Privacy and permissions
Your use of personal information and device permissions is described in the Privacy Policy. The app requests optional permissions when you choose related features. You can change those permissions in iOS Settings, but denying a permission may prevent the related capture feature from working.
7. Membership and payments
Some features may require a Pro membership. Monthly and yearly plans include a 3-day free trial before becoming auto-renewable subscriptions processed through Apple; they continue until cancelled in your Apple account subscription settings. A lifetime plan, if offered, is a one-time purchase. Prices, taxes, availability, introductory offers, billing dates, refunds, and payment methods are controlled by the App Store and may vary by region. RevenueCat may be used to synchronize entitlement status. We cannot cancel or refund an Apple transaction on Apple’s behalf.
8. Intellectual property
The Presias name, logo, app interface, software, design system, and service materials are owned by or licensed to the Presias operator and are protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for personal purposes. No ownership rights are transferred to you.
9. Third-party services
The Service depends on third-party services, including authentication, cloud infrastructure, app-store payments, and entitlement management. Those services may have their own outages, limits, terms, and privacy practices. Presias is not responsible for a third party’s independent service or policy, but we will take reasonable steps to keep the Presias integration working.
10. Disclaimers and liability
The Service is provided on an as-available basis. To the extent permitted by law, Presias disclaims warranties that the Service will be uninterrupted, error-free, or suitable for every purpose. You are responsible for keeping copies of important memories; export or backup features are provided as convenience and should not be treated as the only copy of your content.
Nothing in these Terms limits rights or remedies that cannot legally be limited. To the maximum extent permitted by applicable law, Presias will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Service.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, or if we discontinue the Service. Provisions concerning content ownership, payments already processed, disclaimers, liability, and dispute-related rights survive termination where applicable.
12. Changes and contact
We may update these Terms as the Service changes. We will post the updated version and date on the Web. If a change materially affects your rights, we may provide additional notice. Questions about these Terms can be sent to support@presias.com.
